Mr. Balcarczyk’s practice includes medical malpractice defense, defense of nursing homes and managed care, and casualty and insurance defense.
Mr. Balcarczyk is a graduate of the State University of New York at Buffalo, where he graduated cum laude, and received his Juris Doctor from Albany Law School of Union University. While at law school, Mr. Balcarczyk was an Associate Editor for the Albany Law Review. He served as the Judicial Intern for the Hon. Ralph W. Smith, Jr. – United States District Court for the Northern District of New York. He was also the Secretary for the Celtic Law Society.
Mr. Balcarczyk is admitted to practice in the State of New York and United States District Court for the Western District of New York. He is a member of the State of New York Bar Association and the Bar Association of Erie County. Mr. Balcarczyk is also a member of the Western New York Defense Trial Lawyers Association and the Charles S. Desmond American Inn of the Court.
Prior to joining Gibson, McAskill & Crosby, LLP, Mr. Balcarczyk was Of Counsel at Anspach Meeks Ellenberger, LLP, where his practice included defense of professional malpractice defendants, including nursing homes, hospitals, physicians, physician’s assistants, physical therapists, nurses and nurse’s aides. Mr. Balcarczyk was also a Partner at the former Damon Morey LLP, where he defended medical and nursing facilities and their staff against negligence and malpractice claims. He also represented medical professionals in misconduct proceedings involving the New York State Department of Health, Education Department and Office of Professional Medical Conduct.
Mr. Balcarczyk served as the Assistant City Attorney for the City of Lackawanna from 2013-2016. He was also an elected committee member for the City of Lackawanna from 1994-1996. Mr. Balcarczyk has been active with the Volunteer Lawyers' Project and in 2003, was recognized for his commitment after completing over 150 hours of volunteer work. Damon Morey LLP received the distinguished "Large Firm Award" that year as a direct result of Mr. Balcarczyk's contributions.
