Nicholas P. DeMarco

Biography

Mr. DeMarco’s practice focuses on counseling and representing businesses, employers, and individuals regarding a full range of employment, business, and commercial matters throughout New York.  His practice includes providing legal services to businesses and clients on a strategic level and a day-to-day operations level, including business and corporate formation, review and drafting of contracts and employment agreements, creation of employee policies and manuals, corporate governance, compliance matters, buying and selling commercial assets, intellectual property rights, and succession planning.

Mr. DeMarco works with businesses and employers to provide cost-effective legal advice and counseling in order to take proactive measures to reduce the risks of litigation inherent in any business.  In the event of litigation, however, Mr. DeMarco has extensive experience litigating complex commercial and employment cases on behalf of employees and employer in both state and federal court, as well as before state and federal administrative agencies, including the United States Equal Employment Opportunity Commission, New York State Division of Human Rights, New York State Department of Labor, United States Patent and Trademark Office, and other various state and local employment agencies.  

Mr. DeMarco’s practice also includes representing real estate and construction companies for a wide-range of service, and he also has experience litigating construction contract disputes, mechanic’s liens, foreclosure actions, and other real estate related matters.

Mr. DeMarco is a member of the American Bar Association, the New York State Bar Association and the Bar Association of Erie County. Me. DeMarco is also a member of the Board of Directors for the Buffalo and Erie County Naval & Military Park. 

Mr. DeMarco’s published in New England Journal on Criminal and Civil Confinement (Civil RICO: How Ambiguity Allowed the Racketeering Influenced and Corrupt Organizations Act to Expand Beyond Its Intended Purpose, 38 New Eng. J. on Crim. & Civ. Confinement, Spring 2012).
